Genentech provides information on Cabilly patent reexamination

Genentech, Inc. (S. San Francisco, CA) provided information on the pending reexamination of the Cabilly, et al. United States Patent 6,331,415 ('415 patent), which was ordered by the United States Patent and Trademark Office on July 7, 2005. Genentech had previously disclosed the existence of the reexamination in its Quarterly Report on Form 10-Q for the period ended June 30, 2005, filed with the Securities and Exchange Commission on August 2, 2005.

On September 13, 2005, the United States Patent and Trademark Office issued an initial Office action rejecting the claims of the '415 or Cabilly patent. This action is a routine and expected next step in the reexamination procedure. Genentech plans to respond within 60 days from the mailing date of the action.

The Office action originates from a request for reexamination of the '415 or Cabilly patent filed on May 13, 2005 by a third party.

A final resolution of the reexamination may take from several months to several years. The Cabilly patent remains valid and enforceable while the reexamination is pending.
